Welcome to AMBROSIA. These Terms of Service ("Terms") govern your use of our website (ambrosia-fuel.com) and the purchase of products from ARCHEON LLC, doing business as AMBROSIA ("we," "us," or "our").

By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or purchase our products.

1. ACCEPTANCE OF TERMS

By using this website or purchasing products from AMBROSIA, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, as well as our Privacy Policy, Shipping Policy, and Refund & Replacement Policy, each of which is incorporated into these Terms by reference.

2. ELIGIBILITY

You must be at least 18 years of age to purchase products from AMBROSIA.

By placing an order, you represent and warrant that:

you are at least 18 years old;
you have the legal capacity to enter into a binding contract;
all information you provide (name, address, payment details) is accurate and complete.

We reserve the right to refuse service or cancel orders at our sole discretion if we suspect fraudulent activity or a violation of these Terms.

3. PRODUCTS AND DISCLAIMERS

3.1 Dietary supplements

All products sold by AMBROSIA are dietary supplements intended to support general health and fitness goals.

3.2 Medical consultation

The information provided on this website is for informational purposes only and is not intended as a substitute for advice from your physician or another healthcare professional. You should not use the information on this site for the diagnosis or treatment of any health problem.

Always consult a healthcare professional before starting any diet, exercise programme, or dietary supplement — particularly if you have a known medical condition, are pregnant or nursing, or are taking prescription medication.

3.3 Use as directed

You agree to use our products strictly as directed on the product label. Do not exceed the recommended serving size.

3.4 Product information and images

We make every effort to display our products and their ingredients accurately. Product images are illustrative. Packaging, label design and flavour presentation may vary between production batches.

The Supplement Facts panel printed on the product you receive is the authoritative source for ingredients and dosages. Where the website and the physical label differ, the physical label prevails.

Natural variation in colour, flavour intensity and texture between batches is normal and does not constitute a defect.

4. PRICING AND PAYMENT

4.1 Pricing

All prices are listed in USD and are subject to change without notice. We reserve the right to modify prices or discontinue products at any time. The price charged will be the price displayed at the time you complete your purchase.

4.2 Errors

Despite our best efforts, products on our website may occasionally be mispriced or described inaccurately. We reserve the right to correct any error and to cancel any order placed on the basis of incorrect information, even after the order has been confirmed. Where an order is cancelled on this basis and payment has been taken, a full refund will be issued to the original payment method.

4.3 Payment methods

We accept major credit and debit cards and the other payment methods displayed at checkout. By providing payment information, you represent that you are authorised to use that payment method.

4.4 Payment processing

Payments are processed securely through Shopify Payments and/or authorised third-party payment processors. We do not store your full payment card number on our servers.

4.5 Promotional codes

Discount codes are subject to the conditions stated at the time of issue, cannot be combined unless expressly stated, have no cash value, and may be withdrawn or modified at any time. We reserve the right to cancel orders where a discount code has been used in a manner it was not intended for.

5. ORDERS AND ACCEPTANCE

5.1 Order confirmation

After placing an order you will receive an automated email confirmation. This confirmation does not constitute legal acceptance of your order — it is an acknowledgement that we have received it. The contract is formed when we dispatch the products.

5.2 Our right to cancel

We reserve the right to refuse or cancel any order, including for:

product unavailability or discontinuation;
errors in the description or price of a product;
suspicion of fraud or an unauthorised transaction;
a delivery address we are unable to serve.

If your order is cancelled after your card has been charged, we will issue a full refund to your original payment method.

5.3 Your right to cancel

You may cancel or modify an order within approximately two hours of placing it, by emailing team@ambrosia-fuel.com with your order number. After that window the order is released to production and can no longer be changed. See our Refund & Replacement Policy.

6. SHIPPING AND DELIVERY

We currently ship within the continental United States only. We do not ship to Alaska, Hawaii, or internationally. Please refer to our Shipping Policy for delivery times and methods.

Risk of loss. All items purchased from AMBROSIA are made pursuant to a shipment contract. Risk of loss and title pass to you upon our delivery of the items to the carrier.

7. REFUNDS AND REPLACEMENTS

Full details are set out in our Refund & Replacement Policy, which forms part of these Terms.

Summary. Because our products are consumable, we do not accept physical returns. If a product is not right for you, contact us within 21 days of delivery and we will offer a replacement product or store credit, at our discretion, subject to the eligibility conditions set out in that policy. Monetary refunds are issued in the specific circumstances described there, including where an order arrives damaged, defective or incorrect.

8. INTELLECTUAL PROPERTY

8.1 Ownership

All content on this website — including text, graphics, logos, images, packaging design, photography and software — is the exclusive property of ARCHEON LLC or its licensors and is protected by United States and international copyright laws.

8.2 Trademarks

"AMBROSIA", the AMBROSIA logo, and "Fuel of the Unbroken" are trademarks of ARCHEON LLC. You may not use our trademarks without our prior written consent.

Third-party trademarks appearing on this website — including KSM-66® and Creapure® — are the property of their respective owners and are used to identify ingredients contained in our products.

9. USER CONTENT AND REVIEWS

If you submit a review, photograph, comment or other content to us or to our website, you grant ARCHEON LLC a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, adapt and display that content in connection with our business, including in marketing materials.

You represent that any content you submit is your own, is accurate, and does not infringe the rights of any third party.

We may remove content that is unlawful, abusive, misleading, or that violates these Terms. We do not offer compensation, discounts or free products in exchange for reviews.

10. PROHIBITED USES

You agree not to:

use our products for any illegal or unauthorised purpose;
resell our products without our prior written authorisation;
reproduce, duplicate, copy, sell or exploit any portion of the Services without our express written permission;
transmit any worms, viruses, or code of a destructive nature;
attempt to gain unauthorised access to our systems, or use automated means to scrape the website.

11. THIRD-PARTY LINKS

Our website may contain links to third-party websites or resources. We are not responsible for their content, products, or practices, and a link does not imply endorsement.

12. DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY LAW:

WE DO NOT WARRANT THAT OUR PRODUCTS WILL MEET YOUR SPECIFIC EXPECTATIONS OR ACHIEVE SPECIFIC RESULTS, INCLUDING MUSCLE GAIN, STRENGTH GAIN OR WEIGHT LOSS. INDIVIDUAL RESULTS VARY FROM PERSON TO PERSON AND DEPEND ON DIET, TRAINING, CONSISTENCY AND INDIVIDUAL PHYSIOLOGY.

WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.

13. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW:

ARCHEON LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR PRODUCTS OR WEBSITE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR PRODUCTS IN QUESTION.

This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability or any other basis.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages; in those jurisdictions our liability is limited to the greatest extent permitted by law.

14. INDEMNIFICATION

You agree to indemnify, defend and hold harmless ARCHEON LLC, its officers, directors, employees and suppliers from any claims, damages, liabilities, costs or expenses (including reasonable attorneys' fees) arising out of:

your use of our products or website;
your violation of these Terms;
your violation of any law or third-party rights.

15. GOVERNING LAW AND DISPUTE RESOLUTION

15.1 Governing law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles.

15.2 Informal resolution first

Before commencing arbitration, you agree to contact us at team@ambrosia-fuel.com and give us 30 days to resolve the dispute informally. Most issues are resolved within one business day.

15.3 Arbitration and class action waiver

Any dispute arising out of or relating to these Terms or your use of our website that is not resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in Sheridan County, Wyoming, or remotely by video conference at your election.

YOU AGREE TO WAIVE YOUR RIGHT TO:

A JURY TRIAL;
PARTICIPATE IN A CLASS-ACTION LAWSUIT;
PARTICIPATE IN A CLASS-WIDE ARBITRATION.

Small claims exception. Either party may bring an individual claim in small claims court, provided the claim qualifies and remains in that court.

15.4 Your right to opt out of arbitration

You may opt out of Section 15.3 within 30 days of your first purchase by emailing team@ambrosia-fuel.com with the subject line Arbitration Opt-Out, stating your name and order number. Opting out will not affect any other part of these Terms, and will not affect your relationship with us in any way.

16. GENERAL PROVISIONS

Severability. If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions remain in full force.

No waiver. Our failure to enforce any provision does not constitute a waiver of that provision.

Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition or sale of assets.

Force majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including carrier disruption, supply shortages, natural disasters, or acts of government.

Electronic communications. By using the Services you consent to receive communications from us electronically, and agree that electronic communications satisfy any legal requirement that a communication be in writing.

Entire agreement. These Terms, together with the policies incorporated by reference, constitute the entire agreement between you and ARCHEON LLC regarding the Services.

17. CHANGES TO TERMS

We may update or modify these Terms at any time. Changes are effective upon posting to our website, and the "Last updated" date above will be revised.

The version of these Terms in effect at the time you place an order is the version that applies to that order. Your continued use of our website after changes are posted constitutes acceptance of the revised Terms.
